Crypto and Stablecoins: GAO’s Urgent Call for Legislative Action in Blockchain Regulation

Blockchain technology has undoubtedly revolutionized the world of finance, offering faster and more cost-effective transactions without the need for intermediaries. However, recent incidents of price crashes, fraud, and bankruptcies involving crypto assets, a subset of blockchain-related products and services, have raised concerns about consumer protection and regulatory oversight.

A report, published earlier this week, by the U.S. Government Accountability Office (GAO) delves into the risks and gaps in regulatory authority surrounding blockchain-related financial products and services. In particular, GAO looks at crypto and stablecoins. Here are the key findings and recommendations from the report:

  • Blockchain technology enables tamper-resistant transactions without a central authority, providing potential cost savings and faster transactions.
  • Recent incidents of price volatility, fraud, and bankruptcy highlight the risks crypto assets pose to consumers and investors.

Regulatory Gaps and Risks:

  1. No comprehensive federal financial regulator oversees the spot market for non-security crypto assets, leaving users vulnerable to unfair and manipulative trading practices.
  2. Stablecoins, crypto assets purported to maintain a stable value relative to fiat currency, lack uniform standards for reserve levels and public disclosure, posing risks to financial stability and user redemption requests.
  3. Regulators lack an ongoing coordination mechanism to timely address blockchain-related risks, potentially impeding the development of appropriate responses.

GAO Recommendations:

  • Congress should consider legislation to provide comprehensive oversight of non-security crypto asset spot markets and stablecoins, ensuring user protection and financial stability.
  • Seven financial regulators, including the Consumer Financial Protection Bureau, Commodity Futures Trading Commission, Federal Reserve, and others, should jointly establish or adapt a formal coordination mechanism to identify and address blockchain-related risks in a timely manner.
